Please read these Terms of Service ("Terms") carefully before using the Poker Spot mobile application (the "App") operated by William Dubuque ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
You must be at least 13 years of age to use the App. By using the App, you represent and warrant that you meet this requirement. If you are under the age of majority in your jurisdiction, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.
Poker Spot is a skill-training and record-keeping tool. It does not facilitate, process, or transmit real-money wagering. You are solely responsible for ensuring that your use of the App complies with all applicable laws in your jurisdiction, including any laws relating to gambling or poker.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App for your personal, non-commercial purposes. You may not:

Subscriptions are billed through the Apple App Store or Google Play Store. Your subscription will automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date. You can manage and cancel subscriptions in your device's account settings.
All purchases are processed by Apple or Google. Refund requests must be submitted directly to the applicable platform in accordance with their refund policies. We do not process refunds directly.
Free users may use the App within the following limits: up to 15 sessions, 20 hands logged, 10 simulator hands, and 15 training drills per day. These limits may change over time; we will provide reasonable notice of any changes that reduce free-tier access.
You may enter session data, hand histories, notes, and other content into the App. This content is stored locally on your device. By using the hand-sharing feature, you may voluntarily share encoded hand data with other users. You are solely responsible for any content you create, share, or export using the App.
You represent that any content you share does not violate any third-party rights or applicable law.
The App, including its design, code, graphics, features, and content (excluding content you enter), is owned by us and protected by copyright, trademark, and other intellectual property laws. Nothing in these Terms transfers any intellectual property rights to you.
GTO range data included in the App is sourced from publicly available consensus ranges consistent with GTO Wizard and PioSolver outputs and is provided for educational purposes only.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
Poker Spot is a training and record-keeping tool. We make no guarantee that use of the App will improve your poker results or financial outcomes.
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless us and our affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of the App, your violation of these Terms, or your violation of any third-party rights.
We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your license to use the App will immediately cease. Sections 5 through 11 of these Terms will survive any termination.
These Terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Virginia, and you consent to personal jurisdiction in those courts.
We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date and, where appropriate, providing in-app notice. Your continued use of the App after changes become effective constitutes your acceptance of the revised Terms.
